WHAT IS A 1031 EXCHANGE?
The Tax Deferred Exchange ("1031 Exchange"), as defined in the Internal Revenue Code and corresponding Treasury Regulations, offers real estate investors one of the last remaining and best tax strategies for preserving the value of an investment portfolio and building wealth. By completing a 1031 Exchange, the investor ("Exchanger") can dispose of their investment property, defer the recognition of capital gain taxes that would ordinarily be paid, and leverage all of their equity to acquire replacement investment property. The main distinction is that a properly structured exchange provides tax deferral because the Exchanger does not directly receive the proceeds. In a sale, however, the seller receives the proceeds and must pay taxes to the extent of their capital gain.

HOW DO I SELECT A QUALIFIED INTERMEDIARY?
A successful 1031 Exchange involves satisfying complicated legal requirements. The failure to comply with any element of the 1031 Code and Exchange Regulations can jeopardize the potential tax deferred status of the transaction. Therefore, when considering a 1031 Exchange, Exchangers should always obtain advice from their tax or legal counsel and seek out the expertise of a qualified exchange professional. Exchangers should always inquire about the security of the exchange funds held by the Qualified Intermediary and whether there is sufficient bonding and professional liability insurance.
GLOSSARY OF 1031 EXCHANGE TERMS
Capital Gain: Difference between the selling price and the adjusted basis of a property.
Cost Basis: Original cost in acquiring a property.
Like-Kind Property: Property that is held by the Exchanger for investment or productive use in a trade or business.
Qualified Intermediary: A third party that is not related to, or the agent of, the Exchanger, and who facilitates a 1031 Exchange on behalf of Exchangers, Sellers, and Buyers.
Relinquished Property: Property the Exchanger owns and wants to sell in a 1031 Exchange.
Replacement Property: Property the Exchanger wants to acquire to complete a 1031 Exchange.

OUR CREDENTIALS
Mark A. Berezin, CCIM, CPM, a principal at Infinity, along with his associates, have over
30 years of combined experience in affordable housing development and management, creating over 2,000 affordable housing units over the last two decades. Mr. Berezin received his Bachelor’s Degree in Finance from Babson College, Wellesley, MA in 1981 and since that time has been working in the affordable housing industry.
Mr. Berezin earned the Certified Property Manager (CPM) designation from the Institute of Real Estate Management (IREM) in 1985 and the Certified Commercial Investment Member (CCIM) designation from the Commercial Investment Real Estate Institute (CIREI) in 1999.
